Terms of Service

1. Who we are and what this covers

ma (the “Service”) is a tool that edits product photographs using artificial intelligence. It is operated by HIDN GROUP LLC (“we”, “us”). By signing in or using the Service you agree to these Terms. The Service is for business use; you confirm you are using it for a business and not as a consumer. You agree on that business’s behalf. If you don’t agree, don’t use it.

2. The Service

You upload photographs of products. We send each one to a third-party AI image model, which returns an edited image with a studio-style background and lighting. Results are generated automatically and may vary from one run to the next.

3. Access

Access is by a personal access code that is issued when you buy credits. Keep it private and don’t share it outside your business. Anyone who has your code can spend your credits, and you are responsible for all use under it. We can’t recover a lost code unless you contact us with your payment receipt. We may suspend access or end the Service at any time, with notice where reasonable.

4. Your photos and your rights in them

• You keep ownership of the photos you upload.
• You confirm that you own each photo or have the right to use and edit it, and that doing so doesn’t infringe anyone’s copyright, trademark, privacy or other rights.
• You give us a limited, temporary permission to process your photos, including sending them to our AI provider, only to provide the Service to you.
• Don’t upload photos of identifiable people without their consent, children, or anything illegal, deceptive, hateful, sexually explicit or otherwise prohibited by our provider’s usage policies.

5. The results (“Output”)

As between you and us, you own the edited images the Service returns, to the extent the law allows, and we claim no rights in them. Please understand that:

• Whether AI-assisted images can be protected by copyright depends on the law where you are, and we make no promise that they can.
• Other users may receive similar images. We don’t promise that Output is unique.
• The underlying product design, logos and trademarks in your photos belong to their owners. Editing a photo doesn’t give you rights in someone else’s product or brand.

6. You must check the results before using them

AI editing can change details such as colour, proportions, text, logos, stitching or hardware, even when it is told not to. Review every image against the real product before you publish it. You are responsible for making sure your listings and advertising accurately show what you sell. We aren’t responsible for losses caused by an image that differs from the product.

7. How your data is handled

• Your photos exist in your browser while you work. The Service doesn’t save your photos or results on our servers; they are passed to our AI provider to be edited and the result is returned to you.
• Our AI provider is OpenAI. Under OpenAI’s API terms, content sent through the API isn’t used to train its models by default, and may be kept for up to 30 days for abuse monitoring (longer where the law requires). OpenAI’s terms and policies apply to that processing.
• Payments are handled by Stripe. We never see or store your card details. We keep your email address, your access code and your credit balance so you can sign in and use what you bought.
• We keep basic technical logs (for example request times, errors, and the cost of each edit). They don’t include your images.

8. Acceptable use

Don’t misuse the Service. That includes trying to break or probe it, reverse engineer it, scrape or resell it, bypass limits or access controls, overload it, or use it to break the law or others’ rights. You must also follow the usage policies of our AI provider.

9. Fees

Prices are in US dollars (USD) and are shown when you buy. Each Standard-quality generation, including a redo, uses one credit, and each High-quality generation uses three. If a generation fails, the credit is returned to you. Credits that have been used are not refundable. Unused credits can be refunded within 30 days of purchase. Prices exclude any taxes, which you are responsible for. We may change prices on notice, and a change won’t apply to credits you have already bought.

10. No warranty

The Service is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, including that the Service will be uninterrupted or error-free, or that results will be accurate, suitable for any purpose, or free of defects.

11. Limit of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for lost profits, sales or data. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim, or US$100 if you paid nothing. Nothing here limits liability that cannot be limited by law.

12. Your responsibility to us

You will cover our reasonable losses and costs arising from a third-party claim that your photos, or your use of the Output, infringe someone’s rights or break the law.

13. Ending

You can stop using the Service at any time. We can suspend or end your access if you break these Terms or if we stop offering the Service. Sections that by their nature should survive (for example 5, 6, 10, 11, 12 and 14) will continue.

14. Changes, governing law and contact

We may update these Terms; the date above shows the latest version, and continued use means you accept it. These Terms are governed by the laws of the State of California, USA, and disputes will be handled exclusively in the state and federal courts located in Orange County, California.
